1. Parties and Purpose of the Agreement
This Terms and Conditions Agreement regulates the legal rights and obligations between the user ("User/Customer") who uses, registers, or places an order on the website of Sharma Coffee ("Seller/Service Provider"). By accessing the site, you are deemed to have accepted these terms.
2. Website Use and Membership
The user confirms the accuracy of the information shared on the site. Account security is the user's responsibility. The use of software that disrupts the operation of the website or unfair data extraction is prohibited and incurs legal liability.
3. Products, Pricing, and Orders
All coffee beans, brewing equipment, and workshop tickets listed on the website are priced including VAT. Sharma Coffee reserves the right to change prices and product descriptions without prior notice. The shipping phase begins after the order is confirmed.
4. Shipping, Delivery, and Damage Responsibility
After orders are delivered to the shipping authority, a tracking number is provided to the customer. The recipient is obliged to check the package at the time of delivery and to have the shipping authority prepare a "Damage Report" in case of damage.
5. Right of Withdrawal, Return, and Exchange
According to the Law on the Protection of Consumers, the right of withdrawal can be exercised within 14 days for unopened brewing equipment and accessories. However, according to Law No. 6502 and the Regulation on Distance Contracts, the right of withdrawal does not apply to ground or whole coffee products that have been opened, are likely to expire, or are unsuitable for return due to hygiene/health reasons.
6. Intellectual and Industrial Property Rights
The Sharma Coffee brand, logo, website design, unique coffee recipes, and visual content belong to Sharma Coffee. They cannot be copied, reproduced, or used for commercial purposes without permission.
7. Resolution of Disputes
Turkish Law shall apply to any disputes arising from this contract. Consumer Arbitration Committees and Consumer Courts, as well as Istanbul (Çağlayan) Courts and Enforcement Offices, are authorized.
